RECOMMENDATION OF APPROVAL OF A FINAL PLAT FOR NORTH CAPE FARMS
SUBDIVISION BY METRO ENGTNEERING, LOCATED IN THE SE ‘A OF SECTION 13
(TAX KEYNO. 2212.999) 0
WHEREAS, On February 12, 1999 a final plat was submitted by Metro Engineering for North
Cape Farms Subdivision on the property located in the SE ‘A of Section 13, and
WHEREAS, Said plat consists of 23.6 acres, and proposes 22 lots, ranging from 20,112 square
feet to 329.135 square feet (an outlot) in size, and
WHEREAS, Said property is to be rezoned with the approval of the Fianl Plat by the
Common Council to RSE/OPD Suburban Estate District with a Planned Development Overlay,
requiring a minimum lot size of 40,000 square feet and an average minimum width of 150 feet,
and a majority of said lots do not appear to meet the minimum requirements but under the OPD,
Planned Development Overlay, a reduced minimum lot size and average minimum width is
permitted, and must maintain the same overall density, and
WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission’s
previously approved preliminary plat, approved under Resolution #P.C. 166-98, on October 20,
1998. and
WHEREAS. The Land Use 2005 Plan depicts this area for low density residential
development and this proposed final plat meets that goal, and e WHEREAS, Said parcels will be serviced by City sewer and will access water through
private wells.

THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a 23.6 acre, 22 lot, final plat for the North Cape Farms Subdivision by
Metro Engineering located in the SE ‘A of Section 13 subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and payment of
all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if
applicable, establishment of a Subdivider’s Agreement and Letter of Credit.
BE IT FURTHER RESOLVED, That a DXF or COG0 file of this final plat be submitted
to the City prior to City signatures being placed upon the CSM (3-1/2” diskette).
BE IT FURTHER RESOLVED, approval subject to the inclusion of Waukesha County
comments regarding the final plat, the final plat must denote which lots are not permitted a “walk-
out” basement, a five foot “Street Tree” easement along all interior street lot frontage be
illustrated, and the City of Muskego and City of Franklin to record deed restrictions with
Waukesha County regarding the property with the outbuildings.
