APPROVAL OF AN AMENDMENT TO A LANDSCAPE PLAN FOR THE MUSKEGO
MOVlE PLEX PROPERTY LOCATED AT S67 W 1949 1 TANS DRIVE
RESOLUTION #P.C. 21-99
WHEREAS, Plans were submitted by Catherine Zmudzinski to amend the existing
landscape plan of the Muskego Movie Plex property located in the SE Yi of Section 5 at S67
W I9491 Tans Drive on February 1 I, 1999, and
WHEREAS, The existing property contains a four (4) screen theater under construction,
and
WHEREAS, The property is zoned B-2 Local Service Center District and the existing use
is in conformance to all the requirements of said zoning district, and
WHEREAS, The proposed amendment is in response to DNR regulations prohibiting
deep rooted plantings on the cap of a landfill, and as such, the proposal is to replace the approved
trees in the parking lot area with Large Pfitzer Junipers in conformance with Design Manual size
requirements.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
building, site and operation plan for planting Large Pfitzer Junipers in the parking lot area at the
property located at S67 W19491 Tans Drive, for Catherine Zmudzinski. e
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas building facades and
drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
THEREFORE BE IT FURTHER RESOLVED, That the displaced trees in the parking lot
landscape islands be planted in the area to the north of the building and the parking lot.
BE IT FURTHER RESOLVED, That displaced trees will be planted to the north
and east up to 50% of lost plants and landscape islands will be planted with a variety of
species, all subject to DNR and City StatTapproval.
