RECOMMENDATION OF APPROVAL OF THE CREATION OF CHAPTER 17, SECTION
9.11 OW OVERLAY WELLHEAD PROTECTION DISTRICT FOR THE CITY OF
MUSKEG0 BY THE PUBLIC UTILITIES COMMITTEE
WHEREAS, Pursuant to Wisconsin Legislative Act 410 of 1984 and the requirements of
Wisconsin Administrative Code Section NR 811,,16(5), Chapter 17:9.11 Overlay Wellhead
Protection District is proposed to be created, and
WHEREAS, The residents of the City of Muskego depend exclusively on groundwater
for a safe drinking water supply, and
WHEREAS, It is recognized that certain land use practices and activities can seriously
threaten or degrade groundwater quality, and
WHEREAS, The intent of this overlay district is to protect the City of Muskego's
municipal water and well fields, and
WHEREAS, The regulations of this district have been reviewed by the Public Utilities
Committee and are brought forward for formal adoption, and
WHEREAS, Upon the petition of the Public Utilities Committee, a public hearing has
been scheduled before the Common Council on February 9, 1999. e THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council the creation of Chapter 17:9.11 OW Overlay Wellhead
Protection District in recognition that certain land use practices and activities can seriously
threaten or degrade groundwater quality, and with sensitivity to the fact that the residents of the
City of Muskego depend exclusively on groundwater for a safe drinking water supply.
