APPROVAL OF A CONCEPTUAL DEVELOPMENT PLAN FOR A SUBDIVISION BY
CARlTY LAND CORPORATION, LOCATED IN THE SE 114 OF SECTION 3 AND THE NE
%OF SECTION 10 (S70 W15781 JANESVILLE ROAD)
WHEREAS, A conceptual development plan for 139.6 acres, with a 25 acre business component
and a 141 single family component, was submitted by Carity Land Corporation of the Luedke property
located east of the Guernsey Meadows Addition No. 1 Subdivision and Lake Drive and south of
Janesville Road in the SE 1/4 of Section 3 and NE Yi of Section 10, on January 22, 1999, and
WHEREAS, Said property is partially zoned RS-3, Suburban Residence and RS-2,
Suburban Residence, requiring minimum lot sizes of 15,000 and 20,000 square feet respectively
and an average minimum width of 100 feet and 110 feet respectively, and said lots appear to meet
primarily the minimum zoning requirements of an RS-3 zoning district, and
WHEREAS, The 2005 Land Use Plan depicts this area as set aside for Medium Density
Residential development and, with exception to the business component, the plans submitted
appear to conform, and
WHEREAS, Said parcels are within the City’s sewer service area and will be required to
e access municipal water, and
WHEREAS, Illustrated outlots contain 40.2 acres of open space with much of said open
space consisting of the 100 year floodplain.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 139.6 acre,
141 single family lots and 25.9 acres commercial along Janesville Road, conceptual development
plan by Carity Land Corporation, located in the SE 114 of Section 3 and NE Yi of Section 10 and
will be receptive to the submittal of a rezoning petition, preliminary plat and formal development
plan reflecting the parameters established by this conceptual approval.
