PCR1999013AMENDED **(2-16-99) AMENDED *(2-2-99) RESOLUTION #P.C. 13-99 RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP FOR A TWO (2) LOT LAND DIVISION FOR THE DUVE PROPERTY LOCATED IN THE NW Vi OF SECTION 33 (TAX KEY NO. 2290.995.002) WHEREAS, On January 21, 1999 a certified survey map was submitted by Melvin Duve for a two (2) lot land division in the NW Vi of Section 33, of the Duve property, addressed as W187 S10610 Kelsey Drive, and WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan Commission's previously approved sketch review, under Resolution #P.C. 88-98, on May 11, 1998, and WHEREAS, Said property is zoned R-1, Country Home, requiring a minimum lot size of 80,000 square feet and an average minimum width of 200 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, The Land Use 2005 Plan depicts this area for agricultural and rural development, and the proposed lots will be well within the recommended two to five acre minimum encouraged by the Comprehensive Plan with the R-l zoning, and 0 WHEREAS, Said parcels will not be serviced by City sewer and will access water through private individual well facilities. 0 THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified Survey Map being submitted creating a two (2) lot land division in the NW Vi of Section 33 of the Duve property subject to the delineation of any wetland and floodplain areas. Wetlands to be delineated by the Army Corps, DNR or SEWERPC. Floodplain to be delineated by a surveyor, BE IT FURTHER RESOLVED, That a DXF or COG0 file of this CSM be submitted to the City prior to City signatures being placed upon the CSM (3-112" diskette). *THEREFORE BE IT FURTHER RESOLVED, That a sunset clause be placed on the 1,350 square foot structure with a primary structure to be constructed within twelve (12) months. **BE IT FURTHER RESOLVED, THAT A PRIMARY STRUCTURE BE STARTED WITHIN ONE (1) YEAR AND OUTBUILDING TO BE REDUCED BY 600 SQUARE FEET OTHERWISE THE OUTBUILDING IS TO BE REMOVED.
