RECOMMENDATION OF APPROVAL OF A FINAL PLAT FOR THE AVIAN ESTEATES
RESOLUTION #P.C. 06-99
SUBDIVISION BY JACK SCHWABENLENDER, LOCATED IN THE SW1/4 OF SECTION 3
WHEREAS, On November 24, 1998 a final plat was submitted by Jack Schwabenlender for
Avian Estates Subdivision in the Schwabenlender property located in the SW 114 of Section 3, and
WHEREAS, Said plat consists of 11,295 acres, and proposes eight lots, ranging from 20, 193
square feet to 6.813 acres (an outlot) in size, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, requiring a
minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and said lots
meet said minimum zoning requirements, and
WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission’s
previously approved preliminary plat, approved under Resolution #PC 77-98, on April 28, 1998,
and
WHEREAS, The Land Use 2005 Plan depicts this area for medium density residential
development and this proposed final plat meets that goal, and
WHEREAS, Said parcels will be serviced by City sewer and will access water through
individual wells. e THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a 1 1.295 acre, 8 lot, final plat for the Avian Estates Subdivision by Jack
Schwabenlender located in the Schwabenlender property in the SW 1/4 of Section 3 subject to
resolution of technical discrepancies as identified by the City Planning Department and City
Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and
outstanding assessments if applicable, establishment of a Subdivider’s Agreement and Letter of
Credit.
BE IT FURTHER RESOLVED, That a DXF or COG0 file of this final plat be submitted
to the City prior to City signatures being placed upon the CSM (3-1/2” diskette).
THEREFORE BE IT FURTHER RESOLVED, That a sign stating “Road To Be
Extended’ be installed.
