PCR1998203RESOLUTION #P.C. 203-98 APPROVAL OF AN AMENDMENT TO A BUILDING, SITE AND OPERATION PLAN FOR THE FINDLEY PROPERTY LOCATED AT W186 S9159 RACINE AVENUE (TAX KEY NO. 2243.997) WHEREAS, Plans were submitted on December 4, 1998 by Steve Findley to amend the existing building, site and operation plan of the Findley property located at W186 S9159 Racine Avenue, and WHEREAS, The existing property contains a 36’ X 45’ (1,620 square feet) pole building as approved by Resolution #P.C. 86-96 subject to Board of Appeals approval, and said resolution specifically excluded a 14’ X 45’ lean-to (630 square feet), and WHEREAS, Through appeal #18-96 the 36’ X 45’ pole building was approved exclusive ofthe 14’ X 45’ lean to, and WHEREAS, Said variance was required as the property was calculated to be 178,596 square feet thus limiting the size of accessory structures to 1,786 square feet, and when considering that a garage totaling 780 square feet existed on the property, only a building totaling 1,006 square feet could have been constructed, and .. WHEREAS, The petitioner has submitted new information stating that the property is actually 18 1,082 square feet and the requested lean-to is now only 9’ X 45’ (405 square feet), and 0 that the lean-to is necessary for the health of a horse, and. WHEREAS, Neither the proposed addition, nor the existing pole building is proposed to be used as a commercial stable or to house any other horses than those owned by the current property owner on the subject property, and WHEREAS, This request, if approved by the Board of Appeals, will result in an additional 405 square feet of building which represents a total variance on the property of 1,109 square feet (based upon the lot size numbers presented for Resolution #P.C. 86-96 and appeal #18-96). THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended building, site and operation plan for a 9’ X 45’ lean-to addition to an accessory structure at W 186 S9159 Racine Avenue (Tax Key No. 2243.997) for Steve Findley subject approval by the Board of Appeals. BE IT FURTHER RESOLVED, That neither the proposed addition, nor the existing pole building is to be used as a commercial stable nor is it to house any other horses than those owned by the current property owner of the subject property. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
