APPROVAL OF A THREE (3) LOT SKETCH LAND DIVISION FOR STATE FINANCIAL
BANK BY JACK SPOERL FOR THE PROPERTY LOCATED IN THE SE 'h OF SECTION 9
(TAX KEY NO. 2169.996: S76 W17655 JANESVILLE ROAD)
WHEREAS, On December 3, 1998 a sketch was submitted by Jack Spoerl for State
Financial Bank for a three (3) lot sketch land division of the Hales Comers Development Corp.
property located in the SE 'h of Section 9, (Tax Key No. 2169.996: S76 W17655 Janesville
Road), and
WHEREAS, The proposed land division would create lots with areas of 17,367 to 27,900
square feet and an average minimum width from 90 feet to 180 feet, and
WHEREAS, Said property is zoned B-3 General Business District and RS-3/0PD,
Suburban Residence/Overlay Planned Development District, requiring minimum lot sizes of
20,000 and 15, 000 square feet respectively, and an average minimum width of 100 feet, and the
proposed parcels appear to meet said minimum zoning requirements for lot square footage and
width, and
WHEREAS, The Land Use 2005 Plan depicts this area as being set aside for commercial
and medium density residential development and this proposal fits within these goals, and
WHEREAS, Said parcels will be serviced by City sewer and water, and
WHEREAS, Parcel 1 would contain structures, which upon proper dedication of right-of- 0 way along the Janesville Road (C.T.H. "L") frontage, shall be located within said right-of-way,
and
WHEREAS, City records indicate that there appears to be existing right-of-way which
needs to be vacated and a portion of the property which City records indicate is still under the
control of subject owner,
THEREFORE BE IT RESOLVED, That the Plan Commission approve this sketch and
the submittal of a Certified Survey Map creating a three (3) lot land division of the Hales Comers
Development COT. property in the SE Vi of Section 9 as depicted in the materials submitted on
December 3, 1998, subject to verification by Waukesha County regarding the acceptability of
structures now being located in the right-of-way of Janesville Road (C.T.H. "L"), and the
resolution of right-of-way vacation and ownership issues.
