APPROVAL OF A 32.7’ X 36.7’ ACCESSORY STRUCTURE FOR
THE FABINSKI PROPERTY LOCATED AT S82 W15980 BASS BAY LANE
WHEREAS, A site plan and construction information was submitted on August 18, 1998,
by Mike Fabinski to construct a 32.7’ X 36.7’ (1,200 square foot) accessory structure at the
Fabinski property located at S82 W15980 Bass Bay Lane, and
WHEREAS, The property is zoned RS-2/0LS, Suburban Residential District with a Lake
Shore Overlay, and where said structure is a permitted accessory use and subject to Plan
Commission review per Section 4.05 (2) C.l, and
WHEREAS, The total square footage for accessory structures is limited to 1.0% of the
total lot area, and the parcel contains an area totaling 216,926 square feet which would allow
2,169 square feet oftotal square footage of accessory buildings, and
WHEREAS, One (1) outbuilding (a cabana) exists on the parcel totaling 146 square feet
leaving only 2,023 square feet for additional outbuildings, and
WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the
ultimate height is limited to 25 feet so long as the lot maintains a minimum of 120,000 square feet,
the architectural appearance would be compatible with the applicant’s surrounding area, and the
materials submitted do not propose the use of this nor any other structure on the property for
business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible
size structure not exceeding 1,200 square feet for the Fabinski property at S82 W15980 Bass Bay
Lane in accordance to Section 4.05 (I) B and 6.1 1 (2) and that subject accessory structure not be
used for the operation of a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per violation, the
initiation of legal action, or both.
