PCR1998131AMENDED RECOMMENDATION TO AMEND CHAPTER 17 FOR BUILDING HEIGHTS AND ADD TIME RESTRICITONS FOR PLAN COMMISSION APPROVAL RESOLUTION #P.C. 131-98 WHEREAS, Under the direction of the Plan Commission Resolutions #PC 98-984 Directive from the Plan Commission to City staff to enforce, as written, Chapter 17:202 (8), Building, Height of, and Resolution #PC 110-98, Recommendation of approval to amend Chapter 17, Section 6.12 and Creating Section 6.13, City of Muskego Zoning Ordinance, time restrictions for Plan Commission Approval and Minimum Review Fees, staff proposes the following changes to Zoning Ordinance: Re& and Recreate Section 17:2.02(8) to read as follows: Building, Height of (A) For one and two family primary structures where public or private roads built to City standards are provided, where the maximum setback from the edge of bard surface is no more tban fifty (SO) feet, and where a community or municipal water system is available, for all residential secondary structures and for all commercial and industrial stmctnres where proper fire access building) to the highest point of the coping of a flat roof, to the deck line of a mansard roof, or to the mid is provided, the average vertical distance from the finished grade at the front building line (front of point of the highest gable of a gambrel, hip or pitch roof Mid point is determined by drawing a horizontal (zero degrees) line between the points where the walls intersect the roof deck or an average thereof. Then draw a vertical (90 degrees) line from the horizontal line to the highest point of the gable. The mid point of this vertical line shall be the height of a gable roof for the purposes of this ordinance. (B) The height of any other structure types, or those not having proper fire street access, the building height shall be defined as the total height of the structure measured with a vertical line from the average finished grade at the front line of the structure to the highest point of the structure. Amend Section 17:5.03(1) Maximum Height Rewined to read as follows: Add a Sentence to this paragraph to read: See Chapter 32 Fire Code for applicable access requirements. Receal Section 17:6.12 and Recreateas Section 17:6 13 Create Section 17:6.12 Time Restrictions for Plan Commission Auurovals to read as follows: Plan Commission approvals granted for building, site and operation plans, signs, second garage structures, temporary structures and sketch land divisions in which the petitioner has not commenced construction activity or preparation of the land, or has not submined a Certified Survey Map or Preliminary Plat within the past 24 months of the date of approval, said apprwal will expire and reapplication will be required A reapplication shall be limited solely to reasonable compliance with current design, locational, and operational requirements. A reapplication shall not involve the basic permissibility of the use where such use is permined by right at the time of reapplication. The Plan Commission may grant one six month extension if requested 30 days prior to the pending expiration date provided that the applicant demonstrates a valid cause. e WHEREAS, A Public Hearing has been scheduled for July 28, 1998, before the Common Council. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval of the above stated amendment to Chapter 17 of the City of Muskego Zoning Ordiance. .
