PCR1998126AMENDED APPROVAL OF A 26’ X 35’ ACCESSORY STRUCTURE FOR THE CHOJNACKl PROPERTY LOCATED AT W151 S6358 GLENBROOK DRIVE 0 RESOLUTION #P.C. 126-98 WHEREAS, A site plan and construction information was submitted on July 9, 1998, by Robert S. Chojnacki to construct a 26 X 35 foot (910 square foot) accessory structure at the Chojnacki property located at W151 S6358 Glenbrook Drive, and WHEREAS, The property is zoned RS-1, Suburban Residence, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the total first floor primary habitable area and contains 1,473 square feet, per assessment records, which would allow 884 square feet of total square footage of accessory buildings and said structure exceeds the permitted square footage, and WHEREAS, No outbuildings exist on the parcel, and WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the ultimate height is limited to 15 feet and appears to exceed the permitted heights, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business I I. related activities THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 884 square feet unless verified primary structure is of adequate sue to support 910 square feet building; building not to exceed 15 feet in height for the Chojnacki property at W151 S6358 Glenbrook Drive in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
