PCR1998122AMENDED APPROVAL OF A CONCEPTUAL BUILDING, SITE AND OPERATION PLAN FOR BURKE PROPERTIES AT THE PROPERTY LOCATED IN THE NE 'A OF SECTION 25 (SOUTHEAST CORNER OF NEW HIGHWAY 36 AND NORTH CAPE ROAD) WHEREAS, Plans were submitted proposing a two (2) lot land division and a gasoline RESOLUTION #P.C. 122-98 service station and convenience store on western most proposed lot, and WHEREAS, The property is zoned B-4, Highway Business and requires a minimum lot sue of 30,000 square feet and an average minimum width of 150 feet, and said lots appear to be in conformance with the B-4 standards, and WHEREAS, A proposed gasoline service station is a permitted conditional use in the B-4 zoning district subject to a Public Hearing before the Planning Commission, and a convenient store is a permitted use by right, and WHEREAS, Truck refueling facilities as illustrated on the Concept Plan are not a permitted use in the B-4 zoning district, and WHEREAS, The plans show a 5,000 square foot building with two (2) canopy areas and primary access to North Cape Road, and a vacant lot with access onto the realigned STH 36, and WHEREAS, The STH 36 Access Plan as developed with State DOT input and adopted by the Plan Commission and Common Council in June of 1995 prohibits direct access onto the realigned STH 36, and WHEREAS, The Comprehensive Land Use Plan for the year 2005 promotes this area for commercial development. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a conceptual building, site and operation plan for Burke Properties at the property located in the NE % of Section 25, southeast comer of the new Highway 36 and North Cape Road subject to application for a conditional use for the gasoline service station. All issues in the Planner's Supplement will be addressed and truck refueling will not be permitted. The project will be in compliance with the Durham Hill Design Guide.
