PCR1998113RESOLUTION #P.C. 113-98 APPROVAL. TO MAINTAIN A 30’ X 45’ ACCESSORY STRUCTURE FOR THE WAUER PROPERTY LOCATED AT W 179 8204 RIESE DRIVE WHEREAS, A site plan and construction information was submitted on June 25, 1998, by David and Jill Salentine for a new residence at the Wauer property located at W179 S8204 Riese Drive, and WHEREAS, The property contains a 30 X 45 (1350 square feet) accessory building on the parcel grounds, and the proposed residence will contain an attached garage, which would make the existing accessory building as a secondary structure, and WHEREAS, The property is zoned L, Lowland, and where said structure is permitted as an accessory use and subject to Plan Commission review per Section 4.05 (2) C. 1 once there is a primary residence on the parcel, and WHEREAS, The total square footage for accessory structures is limited to 1 .O% of the total lot area and a said parcel contains 154,246 square feet which would allow for 1,542 square feet of accessory buildings, and WHEREAS, All structures maintain necessary offsets, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. 0 THEREFORE BE IT RESOLVED, That the Plan Commission approves maintaining the 30 X 45 foot accessory building for the Wauer property at W179 S8204 Riese Drive in accordance to Section 4.05 (1) B and 6.11 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That if construction of the new residence does not substantially commence within 12 months of the date of this approval, petitioner shall remove all remaining structures from the property. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both and that all appropriate razing permits be obtained.
