PCR1998090RESOLUTION #P.C. 090-98 RECOMMENDATION OF APPROVAL. OF A CERTLFIED SURVEY MAP FOR A ONE! (1) LOT LAND DIVISION FOR THE BADERTSCHER PROPERTY LOCATED IN THE NE 'A OF SECTION 7 (TAX KEY NO. 2185.999) WHEREAS, A certified survey map for a one (1) lot land division was submitted by BW Surveying, Inc., for the Badertscher property located in the NE Vi of Section 7 on May 8, 1998, and WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan Commission's previously approved sketch, under Resolution #P.C. 49-98, on April 7, 1998, and WHEREAS, Said property is zoned EA, Exclusive Agricultural, requiring a minimum lot size of 35 acres and an average minimum width of 1,275 feet, and said lot does not meet said minimum zoning requirements, and WHEREAS, The Land Use 2005 Plan depicts this area for suburban residential development, and WHEREAS, Said parcels are not within the City's sewer service area and will not access city water, and WHEREAS, Conditions of the approved sketch resolution included that a note be placed on the face of the certified survey map and the parent parcel stating that any hture land divisions, 0 more than one adjacent to the road reservation, will cause construction of full width street. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approvd to the Common Council of a Certified Survey Map for a one (I) lot land division in the NE Vi of Section 7 of the Badertscher property subject to resolution of tectuucal discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That the property be rezoned to RCE Country Estate prior to approval by the Council of this CSM. BE IT FURTHER RESOLVED, That a DXF or COG0 file of this CSM be submitted to the City prior to City signatures being placed upon the CSM (3-1/2" diskette).
