RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP FOR
A ONE (1) LOT LAND DIVISION FOR THE KING PROPERTY LOCATED IN THE SW %
OF SECTION 19

RESOLUTION #P.C. 080-98
WHEREAS, A certified survey map for a one (1) lot land division was submitted by
Metropolitan Engineering, Inc., for the King property located in the SW 'A of Section 19 on April
24, 1998, and
WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan
Commission's previously approved sketch, under Resolution #P.C. 050-98, on April 7, 1998, and
WHEREAS, Said property is zoned EA, Exclusive Agricultural, requiring a minimum lot
size of 35 acres and an average minimum width of 1,275 feet, and said lot does not meet said
minimum zoning requirements, and
WHEREAS, The Land Use 2005 Plan depicts this area for Agricultural and rural
development and said lot is incompatible, and
WHEREAS, Said parcels are outside the City's sewer service area and will not access City e water
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a Certified Survey Map for a one (1) lot land division in the SW '14 of
Section 19 of the King property subject to resolution of technical discrepancies as identified by
the City Planning Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if relevant.
BE IT FURTHER RESOLVED, That a DXF or COG0 file of this CSM be submitted to
the City prior to City signatures being placed upon the CSM (3-1/2" diskette).
THEREFORE BE IT RESOLVED, That a note be placed on the front of the Certified
Survey Map: parcel 1 is currently zoned EA-Exclusive Agricultural and will become non-
conforming upon sale if buyer is not a family member to those in ownership and operation of the
farm found on the parent parcel.
