PCR1998057RESOLUTION #P.C. 057-98 APPROVAL OF A 26’ X 30’ ACCESSORY STRUCTURE FOR THE WEGNER PROPERTY LOCATED AT W140 S7636 FREEDOM AVENUE WHEREAS, A site plan and construction information was submitted on April 3, 1998, by Gary Wegner to construct a 26’ X 30’ (780 square foot) accessory structure at the Wegner property located at W140 S7636 Freedom Avenue, and WHEREAS, The property is zoned RS-2, Suburban Residence, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C. 1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the total first floor primary habitable area and contains 1,325 square feet which would allow 795 square feet of total square footage of accessory buildings, and WHEREAS, One outbuilding exist on the parcel totaling 384 square feet that would be razed and replaced by the proposed structure, and WHEREAS, The location of the structure does not maintain the necessary offsets for the zoning district, but the setback is fine and the ultimate height is limited to 15 feet, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. 0 THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 780 square feet and with a 20 foot rear yard offset and a 15 foot side yard offset for the Wegner property at W140 S7636 Freedom Avenue in accordance to Section 4.05 (I). B and 6.11 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
