PCR1998054e AMENDED RESOLUTION #P.C. 054-98 RECOMMENDATION OF APPROVAL TO REZONE 45.8 ACRES ON THE NORTHEAST CORNER OF JANESVELE ROAD (C.T.H. L) AND MOORLAND ROAD (C.T.H. 0) FROM RS- I, RSE AND B-3 TO B-3/RSM/OPD WHEREAS, Dreamland Investors, LLC., has submitted a request to rezone the properties located in the SW 114 of Section 2 and the SE ’/4 of Section 3, Tax Key Nos. 2167.995 and a portion of 2172.999 be rezoned from B-3, General Business, RSE, Suburban Estate and RS-1, Suburban Residence to B-3/RSM/OPD, General Business and Multiple Family Residence District with a Planned Development Overlay, more specifically described as follows: Part of the Northeast ‘/r of the Southeast % of Section 3, and pari of the West % of the Southwest ‘A of Section 2, Township 5 North, Range 20 East, in the City of Muskego. Waukesha County, Wisconsin, Bounded and described as follows: Commencing at the northwest corner of said Southwest % of Section 2; thence north 870 44’ 48” east along the north line of said southwest ‘A section 1,338.46 feet to a point; thence south 00” 46’ 01” east along the east line of the west % of said southwest X section 1,164.61 feet to a point on the centerline of Janenille Road; thence south 64” 25’ 29” west along said centerline 906.44 feet to a point; thence south 65“ 56’ 01“ west along said centerline 36.49 feet to a point; thence north 06” 04’ 56 west 197.75 feet to a point; thence south 83’ 55’ 00” west 385.08 feet to a point on the centerline of Moorland Road; thence north 2P 35’ 16” west along said centerline 1,516.66 feet to a point on the north line of the Southeast ‘A of Section 3; to the point of beginning; excluding a 101 foot wide strip of land along the eastern most lot line, and 101 foot wide strip of land trending 630 feet west from the northeast corner of the lands described above. WHEREAS, A Public Hearing before the Common Council has been scheduled at 725 PM on Tuesday, April 28, 1998, and WHEREAS, A conceptual land use development plan has been brought forward to the Plan Commission under Resolution #P.C. 124-98 and this rezoning may proceed upon passage of said resolution, and WR!ZAS, The B-3 zoning district allows for commercial activities of a more general retail and wholesale nature, and of office and service facilities serving a larger community trade area, and the RSM zoning district allows for residential development of “walk-up” type buildings housing 2 or more families and where such development would be compatible with surrounding uses, where density would not create service problems and served by municipal sewer, and the OPD zoning overlay allows for diversification and variation of land uses, structures, open spaces and heights of structures in developments conceive and planned as comprehensive and cohesive unified projects, and WHEREAS, The surrounding properties zoning and land uses are: The property to the north is zoned for medium density residential and low density residential and contains the Glenbrook Subdivision and fm land, The properties to the east are zoned for high density residential development and contains the Golden Country Subdivision, The properties to the south are zoned for medium density residential and contains mostly farmed land, and The properties to the west is zoned for low density development and contain mostly farmland, and WHEREAS, The 2005 Comprehensive Land Use Plan for the City of Muskego as amended through Resolution #P.C. 53 -98 anticipates the requested zoning for the properties as described in the 1'' WHEREAS. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for the rezoning of the properties located in the SW 114 of Section 2 and the SE Yi of Section 3, Tax Key Nos. 2167.995 and a portion of 2172.999 be rezoned from B-3, General Business, RSE, Suburban Estate and RS-1, Suburban Residence to B-3/RSM/OPD, General Business and Multiple Family Residence District with a Planned Development Overlay, more specifically as described in the first WHEREAS. BE IT FCTRTHER RESOLVED, That if substantial work has not commenced to I I implement the proposed concept plan within 12 months of the date of this approval, it is recommended that the zoning of the subject lands revert back to the limits of the B-3, RSE and RS-1 zoning designations prior to the approval of this rezoning request.
