PCR1998051RESOLUTION #P.C. 051-98 APPROVAL OF A MOTHER-IN-LAWFAMILY UNIT FOR THE SLAMANN/HITZ PROPERTY LOCATED AT W200 S10771 EAST SHORE DRIVE WHEREAS, Plans were submitted by Modem Design, Inc., for the Slamann/Hitz property located at W200 SI0771 for a mother-in-law/family unit, and WHEREAS, A mother-in-law/family unit is a permitted accessory use subject to the conditions placed under Section 8.01 (7) B.14, requiring a notification of neighboring parcels within 100 feet of the property and limiting the size of said structure to 800 square feet, and WHEREAS, Neighboring parcels within 100 feet have been notified and said plans indicate that said unit would not exceed 800 square feet, but include two (2) bedrooms for the mother-in-law/family unit, and WHEREAS, The circulation layout is through a bedroom, and WHEREAS, A previous plan was submitted to the Plan Commission under Resolution #PC 201-97 and approved by the Plan Commission on October 21, 1997 and brought for reconsideration on November 11, 1997 and defeated, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of a mother-in- law/family unit for the Slamann/Hitz property located at W200 S 10771 East Shore Drive. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
