APPROVAL OF AMENDMENT TO A BUILDING, SITE AND OPERATION PLAN FOR
THE DLCLM, LTD., PROPERTY LOCATED AT
W188 S8276 GEMINI DRIVE
RESOLUTION #P.C. 22-98
WHEREAS, Plans were submitted to amend the existing building, site and operation plan
of the DLCLM, Ltd., property at W188 S8276 Gemini Drive by The Babich Trust, on February
19, 1998, and
WHEREAS, The property is zoned 1-1, Industrial Park, and contains a conditional use for
retail water craft, snowmobile, and miscellaneous sports equipment and boat accessory sales and
service, and the parcel grounds and building are currently vacant, and
WHEREAS, The petitioner proposes a general freight storage and transfer facility plus
fleet repair and maintenance at this location which would require some alterations to the existing
building and site plan as shown on the plans submitted on February 19, 1998, and
WHEREAS, Repair of vehicles not associated with DLCLM, LTD freight operation will
not be undertaken, and
WHEREAS, Transportation terminals, including trucking and general warehousing are
0 permitted uses by right subject to Plan Commission approval.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
building, site and operation plan for a general freight storage and transfer facility at the property
located at W 188 S8276 Gemini Drive, for The Babich Trust, and repair of vehicles not associated
with DLCLM, LTD freight operation shall not be permitted.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas building facades and
drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
BE IT FURTHER RESOLVED, That five (5) parking spaces should be marked off on site
plan and submitted to Planning Department.
BE IT FURTHER RESOLVED, That sump pump discharge for the loading docks will be
located on Gemini Drive.
