PCR1998017RESOLUTION #P.C. 17-98 6 APPROVAL OF A CONCEPTUAL BUILDING, SITE AND OPERATION PLAN FOR AN AUTOMOBILE RELATED DEALERSHIP AT THE PROPERTY LOCATED IN THE NE '/i OF SECTION 5 WHEREAS, Plans were submitted for a conceptual building, site and operation plan for a 150 car, used car lot to be located along Racine Avenue, north of the Muskego Storage extension (at the intersection of Racine Avenue and Tans Drive) and south of the Mill Valley School park grounds by AMCON on February 6, 1998, and WHEREAS, The property is zoned B-2, Local Service Center, and said use is not a permitted type of land use within the B-2 zoning district and would require a rezoning to at least a B-3, General Business District and a conditional use. and WHEREAS, The plans submitted show a proposed layout illustrating parking and building placement, and WHEREAS, Conceptual plans for building design need to be submitted for Commission review. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a conceptual building, site and operation plan for a used car dealership, subject to the rezoning of the property to a B-3, General Business District, approval of a conditional use, and submittals of plans for conceptual review of building type, prior to the application of final rezoning, conditional use and building, site and operation plan. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of tines of $100 per day, the initiation of legal action, or both.
