RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP FOR
A TWO (2) LOT LAND DIVISION FOR THE DUVE PROPERTY LOCATED IN THE NW 'A
OF SECTION 33
(TAX KEY NO. 2290.995)
WHEREAS, A certified survey map for a two (2) lot land division was submitted by
Melvin Duve, for the Duve property located in the NW '/4 of Section 33 on January 26, 1998, and
WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan
Commission's previously approved sketch, under Resolution #P.C. 221-97, on November 18,
1997. and
WHEREAS, Said property is zoned EA, Exclusive Agricultural, requiring a minimum lot
size of 35 acres and an average minimum width of 1,275 feet, and said lots do not appear to meet
said minimum zoning requirements, and
WHEREAS, Parcel 2 will be rezoned to R-1, Country Home, which requires a minimum
lot size of 80,000 square feet and an average minimum width of 200 feet, and Parcel 1 will remain
as an EA zoned parcel, and

WHEREAS, A Public Hearing for rezoning is scheduled before the Common Council on
WHEREAS, The Land Use 2005 Plan depicts this area for Agricultural and Rural
development, and
WHEREAS, Said parcels are outside the City's sewer service area and will not access city
water. and
WHEREAS, Access onto the property will be off Kelsey Drive
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a Certified Survey Map for a two (2) lot land division in the NW % of
Section 33 of the Duve Property subject to resolution of technical discrepancies as identified by
the City Planning Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That a DXF or COG0 file of this CSM be submitted to
the City prior to City signatures being placed upon the CSM (3-1/2" diskette).
BE IT FURTHER RESOLVED, That the fence must be removed before September 1,
1998
