APPROVAL TO AMEND A BULDTNG, SITE AND OPERATION PLAN FOR
CATHERINE ZMUDZINSKI, AT THE PROPERTY LOCATED AT
RACINE AVENUE AND TANS DRIVE
WHEREAS, The Plan Commission approved of a building, site and operation plan for a
four (4) screen theater at the property located in the SE '/4 of Section 5 (Southeast comer of
Racine Avenue and Tans Drive) under Resolution #P.C. 99-97, on July 1', 1997, and
WHEREAS, The Plan Commission reviewed a revised elevation along the Racine Avenue
side of the building (rear of building) during their meeting scheduled on November 4, 1997,
determined said change would require a revised building, site and operation plan, and
WHEREAS, The changes include a revised west elevation and revised landscaping along
Tans Drive, and
WHEREAS, The elevational changes include a gable and column treatment framing the
two exits, and the landscaping changes which eliminate some trees along Tans Drive and replace
them with low shrubbery
THEREFORE BE IT RESOLVED, The Plan Commission approves of an amended
building, site and operation plan for Catherine Zmudinski at the property located at the southeast 0 comer of Racine Avenue and Tans Drive.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall be
maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of
said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of tines of $100 per day, the initiation of legal action,
or both.
