AMENDMENT TO A BUILDING, SITE AND OPERATION PLAN FOR THE BUSHBERGER AND KURER PROPERTY LOCATED AT S67 W I483 1 JANESVILLE ROAD RESOLUTION #P.C. 227-97 (BUSHY'S PUB) WHEREAS, Plans to expand the existing tavern located at S67 W14831 Janesville Road (Bushy's Pub) were submitted for a conceptual review by Lynn Kurer on November 7, 1997 , and WHEREAS, The property is zoned B-2, Local Service Center District and contains a conditional use. and WHEREAS, The existing structure is a legal nonconforming building, located within the ultimate right-of-way of Janesville Road (CTH L) and within the base setback line of Durham Drive. and WHEREAS, A majority of the proposed expansion area would be within the conformance area of the parcel, with the exception of an area located southwest of the existing building, which has received a variance from the Board of Appeals, and WHEREAS, The existing building contains 1,260 square feet and the addition would include 1, 205 feet of seating, restrooms, and circulation space, totaling 2,465 square feet, and the building facade would be substantially modified 6om its present state, and WHEREAS, Said expansiodremodeling would exceed 50% of the assessed value of the present structure and would also constitute a substantial change to the facility requiring a Public Hearing. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a conceptual amendment to an existing building, site and operation plan and that the existing conditional use be removed.
