APPROVAL TO AMEND A BUILDING, SITE AND OPERATION PLAN FOR THE
BUSHBERGER AND KURER PROPERTY LOCATED AT
W147 S8007 DURHAM DRIVE
RESOLUTION #P.C. 226-97
WHEREAS, The Plan Commission approved of a 200 X 40 foot storage building at W147
S8007 Durham Drive under Resolution #P.C. 123-92, on June 2, 1992, and
WHEREAS, Conditions of approval required that the building be constructed within one
(1) year of approval and that the building would be to store cars, boats and recreational vehicles,
and
WHEREAS, An application for a Building and a Zoning Permit were submitted on
October 23, 1997, for a 133 X 42 foot building classified by the state as a Category 59, storage
facility for boats, cars, recreational vehicles, personal belongings and livestock, and
WHEREAS, A letter from the Plan Department was sent to the petitioner that Plan
Commission approval would be required prior to construction since the one (1) time limit was not
met and also approval of a change of use for the storage of dry material would also be necessary.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of an amendment
to an existing Building, Site and Operation Plan to allow for a 133 X 42 foot storage building to
be located at W147 S8007 Durham Drive. No outside storage will be permitted on the parcel
grounds. Subject accessory structure may not be used for the operation or conduct of any
business related activity.
THEREFORE BE IT RESOLVED, That failure to comply with the terms of this
resolution and the approved site plans shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
