APPROVAL OF A ONE (1) LOT SKETCH LAND DIVISION FOR THE
DUVE PROPERTY LOCATED IN THE NW Vi OF SECTION 33
(TAX KEY NO. 2290.995)
RESOLUTION #P.C. 221-97
WHEREAS, A sketch was submitted on October 3 1, 1997, for a one (1) lot land division
in the NW Yi of Section 33, for the Duve property, located in the southeast comer of the
intersection of Tans Drive and Racine Avenue, and
WHEREAS, Said property totals 25.42 acres and is zoned EA, Exclusive Agricultural and
requires a minimum lot size of 35 acres and an average minimum width of 1,250 feet and said
parcels do not meet said requirements, yet this proposal would create one 5.3 acres parcel and
leave a remnant parcel of 20.12 acres, and
WHEREAS, Rezoning the proposed parcel would conform to the R-1, Country Home
District (80,000 square feet and 200 foot average minimum average width) north of the property
and the main parcel could meet the A, Agricultural District (120,000 square feet and 300 foot
average minimum width) requirements, and
WHEREAS, The total amount of outbuildings on the property exceeds that permitted by
Code and further reduction in the size of the parcel would increase the non-compliance of the e property, and
WHEREAS, Access is proposed off Kelsey Drive and the current and proposed parcels
would not have access to city water or sewer
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified
Survey Map being submitted creating a one (1) lot land division in the NW % of Section 33 of the
Duve property subject to the rezoning of said parcels, the delineation of any wetland and
floodplain boundaries and the finding that the site is suitable for on-site sanitary facilities.
BE IT FURTHER RESOLVED, That the Plan Commission finds the area to be
predominantly undeveloped and thus considers the excess square footage in outbuildings to be
appropriate.
BE IT FURTHER RESOLVED, That the petitioner be directed to rezone the new parcel
R-I, Country Home District, and the remnanvparent parcel to A Agricultural or left at EA,
Exclusive Agricultural, to be determined, concurrently with, or prior to approval of, a CSM that
includes the entire parcel.
