PCR1997218TWICE AMENDED APPROVAL TO AMEND A BUILDING, SITE AND OPERATION PLAN FOR THE LE SAGE PROPERTY (OPEN PANTRY) LOCATED AT S66 W14501 JANESVILLE 0 RESOLUTION #P.C. 218-97 WHEREAS, Plans were resubmitted on May 5, 1998, to replace a gas heling station canopy by Northern Petro Services, Inc., for Open Pantry located on the Le Sage Property at S66 W 1450 1 Janesville Road, and WHEREAS, The parcel contains a conditional use grant to allow for a Gasoline Service Station, and any subsequent change or addition to the approved plans shall first be submitted for approval to the Plan Commission and if in the opinion of the Plan Commission such change or addition constitutes a substantial alteration based on the standards set forth in 5.01 (2) c and 6.03 (1) B, said conditional use must be amended and a public hearing will be required, and WHEREAS, The only changes on site and operation will be the replacement of a canopy covering a single corridor of two pumping stations with a T-shaped canopy covering three fueling stations in a double corridor, and WHEREAS, The existing canopy was legal non-conforming and the new canopy will be the same, but the end of the canopy will be eight (8) feet closer to the road right-of-way than what currently exists. 0 THEREFORE BE IT RESOLVED, That the Plan Commission approves the amendment to the Building, Site and Operation Plan and will not consider this as a substantial change to the existing conditional use and will not require a public hearing be held to amend the conditional use for the property located at S66 W14501 Janesville Road. BE IT FURTHER RESOLVED, That the canopy and signage plans are approved as submitted and a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE 1T FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. THEREFORE BE IT RESOLVED, That petitioner will install new 250 watt fixtures with shield, with the understanding that if fixture is not effective, lights will be changed to standard “flush lens” fixtures.
