PCR1997214AMENDED RECOMMENDATION OF APPROVAL TO VACATE THE EASTERN MOST RESOLUTION #P.C. 214-97 RIGHT-OF-WAY ON LARKSPUR ROAD PETITIONED BY DAVE SCHUMACHER WHEREAS, A request to vacate the eastern most portion of Larkspur Road was submitted by Dave Schumacher on August 12, 1997, and a conceptual review was approved by the Plan Commission under Resolution #P.C. 166-97, on September 9, 1997, and WHEREAS, A petition and legal description of the property to be vacated was filed with the City Clerk in accordance with Section 66.296 (1) of the Wisconsin State Statues on September 22, 1997, and a hearing before the Common Council has been scheduled on November 1 1, 1997, and WHEREAS, The portion of Larkspur Road to be vacated is located in the SE Yi of Section 1, and the original plans for this area of Larkspur Road called to intersect the road with 124' Street and connect it to the Larkspur Road on the western edge of the City of Franklin, and WHEREAS, The area for 124* Street has been vacated, however, a connection for Larkspur Road is still reserved, both in the City of Franklin and the City of Muskego, and vacating the road right-of-way in Muskego would create a non-conforming lot in the City of Franklin, and e WHEREAS, The continuation of Larkspur Road into Franklin is anticipated by the adopted City of Muskego 2010 Street and Highway System Plan Map and the proposed change constitutes a change to said adopted plan, and. WHEREAS, The City of Franklin has been provided notice of this pending action and to date no objection has been filed with the City of Muskego, and THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval of the request to vacate the eastern most right-of-way of Larkspur Road citing the non-substantial change that this request represents in relation to the Adopted City of Muskego 2010 Street and Highway System Plan Map and the established and future traffic pattern in the Hale Park Subdivision. BE IT FURTHER RESOLVED, That pending City Attorney review, financial compensation may be required to be paid to the City by the petitioner and the property owner to the south for that portion of the vacated right-of-way to be coming under private control. BE IT FURTHER RESOLVED, That the road vacation would go to the property to the north with reminder to the property owner to the south.
