PCR1997208a RESOLUTION #P.C. 208-97 APPROVAL TO AMEND A BULLDING, SITE AND OPERATION PLAN FOR BERT SCHNEIDER AT THE PROPERTY LOCATED AT S64 W 18295 MARTIN DRIVE WHEREAS, Plans were submitted to the Planning Department for a proposed amendment to the Building, Site and Operation Plan at the property located at S64 W18295, known as B Michael’s and approved under Resolution #P.C. 137-97 on July 1, 1997, and WHEREAS, The plans submitted indicated that a split rail fence will be installed surrounding the parking area along the eastern end of the lot, a dumpster enclosure with an overhead roof and a boardwalk along the Martin Drive entry, and WHEREAS, The Plan Commission approved of this request subject to the conditions that the parking is paved with asphalt by November 1, 1997 and the Garnet Drive access is gated and only used for emergency or bad weather conditions, and WHEREAS, The resolution stated that the completion of the fencing, dumpster and landscaping will be completed by September I, 1997 The paving of the parking area and installation of the boardwalk will be completed by November 1, 1997 That compliance in perpetuity to this approval is required unless otherwise authorized by the Plan Commission, and 0 WHEREAS, The petitioner seeks an amendment to the approved building, site and operation pian to allow for only the paving of the aprons of the entry areas and for the remaining parking lot poltion to remain as is (recycled asphalt). THEREFORE BE IT RESOLVED, The Plan Commission approves of amending the building, site and operation plan of B. Micheals at S64 W 18295 Martin Drive to allow for only the paving of the aprons of the entry areas and for the remaining parking area to remain as is (recycled asphalt). BE IT FURTHER RESOLVED, That failure to comply with this approval shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both.
