PCR19971970 RESOLUTION #P.C. 197-97 RECOMMENDATION OF REAPPROVAL OF A FINAL PLAT OF DEER CREEK SUBDIVISION NO. 1, FOR PREMIER DEVELOPMENT AT THE PROPERTY LOCATED IN THE SE '/a SECTION 10 WHEREAS, Plan Commission granted a recommendation of approval for a final plat of the Deer Creek Subdivision No. 1, for Premier Development on July 1, 1997 under Resolution #P.C. 90-97, and the Common Council approved of the final plat on July 22, 1997, under Resolution #179-97, and WHEREAS, A preliminary plat was submitted on June 12, 1992, to divide property in the SW 114 of Section 10 into 81 single family lots under RS-2 zoning and was adopted through Resolution #P.C. 152-92, on July 7, 1992, and WHEREAS, A revised preliminary plat was submitted on September 23, 1994, to divide the property into 9 duplex lots and 56 single family lots with an OPD Planned development designation and adopted through Resolution #P.C. 154-94, subject to the removal of all proposed multi family lots, and WHEREAS, A Final Plat was submitted for Deer Creek Subdivision, Phase One of the subject development, on April 14, 1995 for a 36 lot subdivision and adopted through Resolution #P.C. 69-95, and WHEREAS, A Final Plat was submitted for Deer Creek Addition Number 1 on April 18, 1997 and is the subject of this resolution, and WHEREAS, Said submittal of April 18, 1997 substantially conforms to the Deer Creek Preliminary Plat and the resubmittal of the same dated received, September 24, 1997 THEREFORE BE IT RESOLVED THAT, The Plan Commission recommends approval of the Final Plat of Deer Creek Addition Number 1 as submitted on April 18, 1997 and resubmitted on September 24, 1997 subject to resolution of all techcal discrepancies as identified by all objecting and approving agencies, City Engineers, Plan Commission, Common Council, and City Staff as well as submittal of a Subdivider's Agreement and Letter of Credit agreeable to the Common Council. BE IT FURTHER RESOLVED, That bike path be included as an outlot between lots 35 and 36, allowing 10 foot sideyards adjacent to said outlot, and final plat approval being contingent upon final approval of Subdivider's Agreement, Letter of Credit and Public Works Committee.
