PCR1997179* RESOLUTION #P.C. 179-97 APPROVAL OF A FENCE WITHIN THE ULTIMATE RIGHT-OF-WAY FOR THE WEBB PROPERTY LOCATED AT S70 W17575 MUSKEGO DRIVE WHEREAS, Application for a zoning permit to construct a fence within the ultimate right-of-way of Muskego Drive was submitted by Gary Webb on September 9, 1997, and WHEREAS, The existing right-of-way for Muskego Drive is 50 feet, and WHEREAS, The Year 2010 Arterial and Street Highway System Plan proposes all local streets ultimately measure 60 feet, and WHEREAS, No fbture expansion of Muskego Drive is currently anticipated, and WHEREAS, Fencing may be permitted between the base setback line and the existing street right-of-way subject to Plan Commission approval and the owner filing with the City an agreement to the effect that the owner will remove all new construction erected at his expense, when necessary for the improvement of the street and will claim no damage for the same. THEREFORE BE IT RESOLVED, The Plan Commission approves of a four (4) foot high wooden landscaped fence along the current right-of-way subject to the owner submitting an agreement to the effect that the owner will remove all new construction erected at his expense, when necessary for the improvement of the street and will claim no damage for the same.
