PCR1997170AMENDED RESOLUTION #P.C. 170-97 RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP CREATING A TWO (2) LOT LAND DIVISION FOR THE FOSMORE PROPERTY LOCATED IN THE SW 1/4 OF SECTION 8 (TAXKEY NO. 2191.999.003) WHEREAS, A Certified Survey Map was submitted by Dennis Fosmore for a two (2) lot land division at the property addressed as S75 W20300 Hillendale Drive, located in the SW of Section 8, on July 18, 1997, and WHEREAS, The property is zoned R-I, Country Home which requires a minimum lot size of 80,000 square feet and a minimum average width of 200 feet, which both lots do not appear to meet, and WHEREAS, The Plan Commission approved of a two (2) lot land division sketch under Resolution #P.C. 28 -97, on February 18, 1997, with a condition that the property be rezoned to RS-I, Suburban Residence, and WHEREAS, The petitioner has applied to rezone the property to RS-1, Suburban Residence, which requires a minimum lot size of 30,000 square feet and minimum average width of 120 feet, and WHEREAS, Both lots appear to meet the RS-1 zoning requirements, and WHEREAS, Both lots will have City sewer service but will not be serviced by City water, THEREFORE BE IT RESOLVED, That the Plan Commission approve the Certified Survey Map for a two (2) lot land division in the SW 1/4 of Section 8, of the Fosmore Property subject to the rezoning of the property from R-1, Country Home to RS-I, Suburban Residence. BE IT FURTHER RESOLVED, That the Plan Commission recommends approval to the Common Council subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance. BE IT FURTHER RESOLVED, That a DXF or COG0 file of this CSM be submitted to the City prior to City signatures being placed upon the CSM (3-1/2" diskette). BE IT FURTHER RESOLVED, That a note be placed on the certified survey map that prior to building permits being issued, grading and drainage plans must be submitted for review and approval and as-builts must be approved by MMSD.
