PCR19971610 I AMENDED RESOLUTION #P.C. 161-97 APPROVAL OF AN MNDED BUILDING, SITE AM) OPERATION PLAN FOR C.U.S., INC. (BURGER KING FRANCHISE) FOR THE PROPERTY LOCATED AT S74 W17095 JANESVILLE ROAD WHEREAS, Plans were submitted on August 8, 1997, for the renovatiodremodeling of the property at S74 W17095 Janesville Road (Old Hardees Restaurant) by C.U.S., Inc., and WHEREAS, The plans submitted show the building being converted into a Burger King Restaurant and Drive-Thru, and WHEREAS, The proposed changes include exterior painting, re-roofing, installation of a red parapet band, new windows and new signage, and WHEREAS, Proposed changes are to compliment the Pick-n-Savemalgreens Shopping Center, and WHEREAS, The location of said property is within the Downtown Design Guide district boundaries and said document does not permit the painting of the brick. THEREFORE BE IT RESOLVED, The Plan Commission approves of the amended building, site and operation plan for the property located at S74 W17095 Janesville Road subject to no painting of the brick, free standing signage being no greater than 51.5 sqaure feet (including reader board), wall signage not exceeding 46.2 square feet and limited to Janesville Road frontage, red parapet accent stripe being non-illuminated, asphalt connection of bike path to parking lot. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That if the heads on the existing lighting need to be replaced, it will be required to have sodium vapor downcast parallel to ground fixtures. The fifteen (I 5") inch non-illuminated parapet will have a red band. The building will be painted to match the shopping center according to Section 3.01" (2) and Section 3.01-C in the Downtown Design Guide.
