RECOMMENDATION OF APPROVAL BY THE PLAN COMMISSION
TO THE COMMON COUNCIL TO AMEND CHAPTER 17 SECTION 8.01,
COUNTRY ESTATES DISTRICT OF THE CITY OF MUSKEG0 ZONING ORDINANCE
TO CREATE SECTION 8.01 (7) B:13 PERMITTED ACCESSORY USES, HOBBY KENNELS
WHEREAS, Currently, Chapter 13, Section 13.01 (13) of the Municipal Code limits the
number of adult dogs in a residence to two (2), and
WHEREAS, An excess of two (2) dogs is administratively considered a Commercial Kennel
as defined in Chapter 17, Section 2.02 (26) and is only permitted in agricultural and industrial zoned
districts as a conditional use, and
WHEREAS, Residential zoned properties totaling an area of 2.75 acres or more are
permitted one head of domestic livestock per acre, however, administratively, dogs are not
considered as domestic livestock. and
WHEREAS, Chapter 17, Section 8.01, Country Estates District of the City of Muskego
Zoning Ordinance, establishes the permitted uses by right, by accessory and by conditional use that
are reflected on all eight (8) single family residential districts, and
WHEREAS, The Plan Commission proposes to amend Chapter 17, Section 8.01, RCE,
Country Estate District to create Section 8.01 (7) B:13, Permitted Accessory Uses, Hobby Kennels
as stated below:
13. Hobby Kennels: On parcels in the RCE zoning district, or on parcels totaling a
minimum of 120,000 square feet, one additional adult dog per acre, above the
number of dogs permitted per household per Chapter 13 of the Municipal
Code of the City of Muskego, may be permitted upon written notice being
given by the Plan Commission to property owners within 100 feet of the
property in question, and subject to building, site and operation plan approval
by the Plan Commission per Section 6.1 1 of this Zoning Ordinance.
THEREFORE BE IT RESOLVED, The Plan Commission does hereby recommend to the
Common Council of the City of Muskego to amend Chapter 17. Section 8.01 RCE, Country Estates
District to create Section 8.01 (7) B:13, Permitted Accessory Uses, Hobby Kennels as described
above in the fifth ‘WHEREAS”
