PCR1997149RESOLUTION P.C. 149-97 0 RECOMMENDATlON OF APPROVAL BY THE PLAN COMMISSION TO THE COMMON COUNCIL TO REZONE THE PROPERTLES LOCATED IN THE SE % OF SECTION 17, TAX KEY NOS. 2188.985 AND 2188.995, FROM RS-1 COUNTRY ESTATES & SUBURBAN RESIDENCE WITH A PLANNED DEVELOPMENT OVERLAY FOR FREDERICK GRAVES SUBURUBAN RESIDENCE AND RCE COUNTRY ESTATES TO RCEIOPD & RS-I/OPD, WHEREAS, Frederick Graves has requested to rezone two (2) parcels totaling 44.4 acres from RCE Country Estates & RS-1, Suburban Residence to RCE/OPD & RS-I/OPD, Country Estates & Suburban Residence with a Planned Development Overlay, to accommodate a seven lot land division, and WHEREAS, The request for rezoning was a condition of approval for Resolution #P.C. 69- 97, in which a sketch land division for seven lots was approved on April I, 1997, and WHEREAS, The OPD overlay will allow the land owner to develop a private road, constructed to City standard for a rural cross section, to access the proposed lots, while agreeing to restrict the overall density of the development to no more that seven total units (a standard OPD development would permit over 13 units), and WHEREAS, The properties to the south and east are zoned RS-1 and maintain a single family land use on parcels ranging in excess of 30.000 square feet and the DroDerties to the north and " west are zoned RCE and maintain a rural land use of agricultural and single family homes ranging in L. 0 excess of 2.75 acres, and WHEREAS, The City of Muskego Land Use Plan for the Year 2005 anticipates this area to maintain an agricultural and rural character and the proposed lots will be well within the recommended two to five acre minimum encouraged by the Comprehensive Plan, and WHEREAS, A Public Hearing has been scheduled before the Common Council on August 12, 1997 and properties within 300 feet of said parcel have been properly identified. THEREFORE BE IT RESOLVED, The Plan Commission does hereby recommend approval to the Common Council for the rezoning of approximately 44.4 acres located in the SE % of Section 17 from RCE Country Estates & RS-1 Suburban Residence to RCE/OPD & RS-l/OPD, Suburban Residence with a Planned Development Overlay to permit the development of a total of seven single family residential lots. BE IT FURTHER RESOLVED, That prior to the approval of Certified Survey Maps for this development, petitioner shall provide to the City evidence that each proposed home site is suitable for individual on site sanitary facilities (mound or conventional septic systems).
