INTERPRETATION BY THE PLAN COMMISSION REGARDING THE APPLICATION OF
THE PHRASE “COMMERCIAL ENTERTAINMENT FACILITY’ AS FOUND IN SEC
BERGREALITY CENTER, INC.

17:8.12(7)A. OF THE B-2 LOCAL SERVICE CENTER ZONING DISTRICT,
WHEREAS, Reno Berg, of the Realty Center has requested a code interpretation and
determination by the Plan Commission as to the permissibility of a roller rink in a B-2 Local
Service Center district through the classification of such a use as a commercial recreation facility,
and
I WHEREAS, The B-2, Local Service Center district is intended to provide for the orderly
needs of surrounding local community area, and does not define, but does specify commercial
entertainment facility as a permitted use by right, and an outdoor recreation facility and a
permitted use by conditional grant, and
~ and attractive grouping of retail stores, shops, ofices and service establishments serving the daily
WKEREAS, Section 17:2.02(40) of the Zoning Ordinance does classify an outdoor
recreation facility indicating a distinction recognized by the Zoning Ordinance between a
recreational use and an entertainment use, and
WHEREAS, Section 17:5.01(3) Of the Zoning Ordinance indicates that ‘‘ in case of
question as to the classification of a use, the question shall be submitted to the Plan Commission
for determination.”
THEREFORE BE IT RESOLVED, In accordance with Section 17:5.01 Of the Zoning
Ordinance of the City of Muskego, the Plan Commission finds that an indoor roller rink (is not) a
permissible use by right in the B-2 Local Service Center zoning district as it (is not) found to be
appropriate to classify such a use by the term “commercial entertainment facility”, but such use
and other similar uses as an indoor recreational facility in the B-2 Zoning District requiring a
Conditional Use.
