PCR1997112RESOLUTION #P.C. 112-97 RECOMMENDATION OF APPROVAL TO THE COMMON COUNCIL FOR REZONING THE PROPERTY ADDRESSED W124 S7975 NORTH CAPE ROAD RSE. SUBURBAN ESTATE LOCATED IN THE NE 1/4 OF SECTION 16 FROM R-2, COUNTRY HOME TO WHEREAS, The Public Utilities Committe has recommended that the property addressed as W124 S7975 North Cape Road be rezoned from R-2, Country Home to RSE, Suburban Estate, and WHEREAS, The current R-2 zoning district is designated for non-sewer areas with a minimum area of 60,000 square feet and an average minimum width of 150 feet, and WHEREAS, Said lot encompases 67 10 acres and includes approximately 300 feet of frontage along North Cape Road, and WHEREAS, The City of Muskego is placing a lift station on the parcel grounds to serve the newly expanded sewer service in the area of HoltdHi-View, and WHEREAS, The RSE, Suburban Estate zoning district requires a minimum lot area of 40,000 square feet and an average minimum width of 150 feet and said lot appears to meet these ~ restrictions, and e .. WHEREAS, The surrounding properties zoning and land uses are: The property to the north is zoned RS-2/0PD, is serviced by sanitary sewer and includes the development currently known as Tudor Oaks Retirement Community, and The property to the west is zoned R-2 with portions to be rezoned RSE, to accommodate the new sewer service, land uses in this area are medium in density with access via Northview Drive and the Durham Road corridor, and The property to the south includes medium density development that is being rezoned to RSE to accommodate the newly extended sewer service, and The property to the east borders North Cape Road and is adjacent to the City of Franklin. WHEREAS, The Comprehensive Plan depicts the area to maintain medium density development and said rezoning would be in compliance to the goals and objectives of the Comprehensive Plan. WHEREAS, A Public Hearing has been scheduled before the Common Council on June 10, 1997, and properties within 300 feet of said parcel have been properly notified. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for the rezoning of 67 10 acres of the property located at W124 S7975 North Cape Road located in the NE 114 of Section 16 from R-2, Country Home to RSE, Suburban Residence; said rezoning to take affect when the planned sewer system is operational.
