APPROVAL TO AMEND A BUILDING, SITE AND OPERATION PLAN
FOR LANDSCAPING BY SUPERIOR EMERALD PARK AT THE PROPERTY
LOCATED IN THE SE 1/4 OF SECTION 36
WHEREAS, Plans were submitted for the addition of screening
berms at the southeast corner of the SE 1/4 of Section 36,
around the intersection of Union Church Road and USH 45, by
Superior Emerald Park Landfill, Inc., and
feet in height with a 3:l slope along the exterior of the
property and a 5:l slope along the interior of the property, and
WHEREAS, The plans depict three (3) screening berms, 25
six (6) feet apart are lined along Union Church Road and USH 45
at grade level, and
WHEREAS, Two (2) rows of ten (10) foot evergreens that are
WHEREAS, The plans do not depict any landscaping on the
berms themselves.
THEREFORE BE IT RESOLVED, That Plan Commission approves of
the amendment to the Building, Site and Operation plan of
Superior Emerald Park Landfill, Inc., to allow for the proposed
screening berms with the addition of plantings on the berms.
BE IT FURTHER RESOLVED, That all aspects of this plan as e
they relate to landscaped areas and drainage shall be
maintained in perpetuity unless otherwise authorized by the
Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the
conditions of this approval shall result in.the imposition of
fines of $100 per day per violation, the initiation of legal
action, or both.
BE IT FURTHER RESOLVED, That landscaping plan be approved
by Staff.
