PCR1997078AMENDED PLAN FOR CATHY ZMUDZINSKI FOR A MULTI-SCREEN MOVIE THEATER AT APPROVAL OF A CONCEPTUAL BUILDING, SITE AND OPERATION THE PROPERTY LOCATED IN THE SE 1/.4 OF SECTION 5 (SOUTHEAST CORNER OF RACINE AVENUE AND TANS DRIVE) RESOLUTION #P.C. 70-97 were submitted by Cathy Zmudzinski on April 4, 1997, and WHEREAS, Plans for a four (4) screen enclosed movie theater WHEREAS, The plans show the complex located on a 5.5 acre division of a parent parcel zoned B-2, Local Service Center District, and WHEREAS, The B-2 zoning district is intended to provide for the orderly and attractive grouping at appropriate locations of retail stores, shops, office and service establishments serving the daily needs of the surrounding local community area, and WHEREAS, Such use is permitted use by right under a commercial entertainment facility, and THEREFORE BE IT RESOLVED, That the Plan Commission conceptually approve of the Building, Site and Operation plan Section 5 (the southeast corner of Racine Avenue and Tans for Cathy Zmudzinski at the property located in the SE 1/4 of 0 Drive) subject to the following conditions: 1. That a copy of said plans, dated April 4, 1997, be kept on file in the Building Department and 1/4 Section file along with any subsequent changes to the same. 2. That if occupancy is requested prior to the completion of equal to twice the value of said costs must be submitted to landscaping, a bond, letter of credit or cashiers check the Planning Department along with an itemized price list of said costs from a qualified dealer. Public Works Committee for review and approval prior to 3. That grading and drainage plans be submitted to the application for building permits. 4. That all aspects of this plan as they relate to landscaped areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. 5. Evidence of County D.O.T. approval be provided to the City for the access drive on Racine Avenue. 6. That failure to comply with the conditions of this approval shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both. BE IT FURTHER RESOLVED, As it was stated in the minutes, that title of Resolution #P.C. 78-97 be changed from Approval of a Building, Site and Operation Plan..to Conceptual Approval of a Building, Site and Operation Plan...and all references to Building, Site and Operation Plan (grading and drainage plans need to be submitted to Public Works; revised landscaping plans; and monument sign need to be submitted to the Commission).
