PCR1997067AMENDED APPROVAL OF A SKETCH CERTIFIED SURVEY MAP CREATING A TWO (2) RESOLUTION #P.C. 67-97 LOT LAND DIVISION FOR RUFUS AND MERLE LOWE AT THE PROPERTY LOCATED AT W208 58151 HILLENDALE DRIVE (2) lot land division on the property located at W208 58151 Hillendale Drive by Rufus and Merle Lowe, and WHEREAS, A sketch was submitted on March 13, 1997, for a two Suburban Residence District which requires a minimum lot size of 30,000 square feet and an average minimum width of 120 feet and said lots appear to meet these requirements, and WHEREAS, The subject property is currently zoned RS-1, WHEREAS, The subject division is part of the OPD of Apple Tree Estates for which a non-substantial change allowing 2.95 acres to be sold to an adjacent land owner was accomplished through Resolution P.C. #195-95, and WHEREAS, Subject division does not conform to the approved Preliminary Plat of Apple Tree Estates and is therefore a change to said OPD. THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified Survey Map being submitted creating. a two (2) lot land division at property located at W208 S8151 Hillendale Drive for Rufus and Merle Lowe subject to resolution of all technical discrepancies as identified by the City Engineers, City Staff, Plan Commission and Common Council. BE IT FURTHER RESOLVED, That this petition is found not to constitute a substantial change to the OPD of Apple Tree Estates as it does not affect the open space or density of the approved OPD. BE IT FURTHER RESOLVED, That to eliminate the land-locked parcel the two remnant parcels will become one. The outbuilding will need to be decreased to 1065 square feet.
