PCR1997066RECOMMENDATION OF APPROVAL BY THE PLAN COMMISSION TO THE RESOLUTION #P.C. 66-97 COMMON COUNCIL FOR A ROAD VACATION FOR JOHN MARENDA AT THE PROPERTY LOCATED AT 576 W14056 MC SHANE DRIVE IN THE SE 1/4 OF SECTION 11 WHEREAS, Plans were submitted by John Marenda for a road vacation along Freedom Avenue on the northwest corner of MC Shane Drive and Freedom Avenue on February 28, 1997, and WHEREAS, Following the vacation of subject right-of-way, width requirement for a local street. Freedom Avenue width will be over 60 feet meeting the minimum THEREFORE BE IT RESOLVED, That the Plan Commission recommend approval to the Common Council of the City of Muskego for the Drive in the SE 1/4 of Section 11 subject to a 15 foot radius road vacation of the property located east of 576 W14056 McShane being established at the southeast corner of the area to be vacated. BE IT FURTHER RESOLVED, That pending City Attorney review, the petitioner for that portion of the vacated right-of-way to financial compensation may be required to be paid to the City by be coming under the petitioner's control.
