RECOMMENDATION OF APPROVAL BY THE PLAN COMMISSION TO THE
COMMON COUNCIL FOR AMENDING THE ZONING ORDINANCE TO ADD
SECTION 9.10 HEIGHT DISTRICT OVERLAY
WHEREAS, The Chapter 17: Section 9 establishes the nine (9)
overlay zoning districts for the City of Muskego, and
WHEREAS, The Overlay Districts are established to provide
for the possibility of superimposing upon a basic district
certain additional permissive uses and regulatory standards
applicable thereto without disturbing the underlying basic
district regulations, and
WHEREAS, The basic intent of an overlay zoning district is
and in effect represent the granting of specifically defined
similar to that upon which conditional use grants are premised
special use rights in specifically defined areas, and
17, Section 9 to add Section 9.10 to establish an additional
overlay district, and
WHEREAS, The Planning Department proposes to amend Chapter
WHEREAS, This would create Section 9.10 whose statement of a intent would read as follows:
OHD Heiqht District. A. Statement of Intent: This
district is intended to provide for qreater heiqhts for
principal structures located on/in General Business
(B-3), Highway Business (B-4) and industrially zoned
parcels or districts where it is determined that
circumstances of location, land characteristics or type
of existing and proposed use or building shall not
adversely impact adjacent and surrounding properties.
This designation may be utilized for individual as
well as grouped sites. (a three (3) story or 40 foot
height is proposed)
WHEREAS, A detailed description of the OHD Height District
is attached to this resoultion as EXHIBIT A.
NOW THEREFORE BE IT RESOLVED, The Plan Commission does
hereby recommend to the Common Council of the City of Muskego
described in the above 5th and 6th "WHEREAS".
