PCR1997054RECOMMENDATION OF APPROVAL BY THE PLAN COMMISSION TO THE RESOLUTION #P.C. 54-97 COMMON COUNCIL FOR THE REZONING FOR PARK ESTATES, LOCATED IN THE NE 1/4 AND SE 1/4 OF SECTION 18 WHEREAS, A Sketch for a Preliminary Plat was submitted on June 24, 1996, to divide property in the NE 114 and SE 114 of Section 18 into five duplex lots and 24 single family units, and RS-2, Suburban Residence and the location of the 24 single family lots is currently zoned RS-1, Suburban Residence, and WHEREAS, The location of the duplex lots is currently zoned WHEREAS, The basic zoning is proposed to remain the same, but a Planned Development overlay would be applied to the entire development to preserve open space while allowing a mixed development, and WHEREAS, With the underlying zoning remaining the same, there would not be any conflict with the existing land uses or densities, and petitioners are given more flexibility when considering widths of the lots and allow the use of duplex lots near the preservation of open space through reduced densities. intersection of Janesville Road, all in exchange for the WHEREAS, With the Planned Development Overlay, the THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval of the rezoning as submitted of Park Estates, located in the NE 1/4 and SE 1/4 of Section 18, from RS-l/RS-2, Suburban Residence Districts to RS-l/RS-Z/OPD, Suburban Residence Districts with a Planned Development Overlay. BE IT FURTHER RESOLVED, That this petition will result in a mixed use development with reduced densities serving to preserve open space.
