RESOLUTION #P.C. 47-97
DEBACK PROPERTY LOCATED AT THE SW AND SE 1/4 OF SECTION 21
WHEREAS, The Plan Commission approved a Certified Survey Map
for the DeBack property located in the SW and SE 1/4 of Section
21 under Resolution #P.C. 121-96, and
indicated a suitable mound system based upon speculated changes
WHEREAS, The soil and site evaluation report submitted
to the rules regulating on-site sanitary waste systems, and
WHEREAS, These changes have not occurred, and
WHEREAS, The parcel created has no recognized means of
created in non-compliance with the Land Division Ordinance of
appropriately addressing sanitary wastes and has therefore been

THEREFORE BE IT RESOLVED, That the Plan Commission
Certified Survey Map for Harold DeBack for the property located
recommends that the Common Council rescind the approval of the

unable to adequately support an on-site sanitary sewer facility
recognized by all approving authorities as being appropriate.
$600, paid to the City by Mr. DeBack, be returned to same.
