PCR1996207APPROVAL TO AMEND THE OVERLAY PLANNED DEVELOPMENT OF THE RESOLUTION P.C. 207-96 DEER CREEK SUBDIVISION TO PROVIDE FOR A REDUCTION IN SIDE YARD OFFSETS general variance for the side yard offsets to allow a minimum offset of ten (10) feet for Lots 1 through 10 in Block 1, and WHEREAS, Premier Development, Incorporated has requested a WHEREAS, The original Planned Development did grant the developer special exemption to grant variances in terms of setbacks at the time of architectural control review, and 20 feet per RS-2, Suburban Residence District, and WHEREAS, The required side yard offsets are set at 15 and WHEREAS, The proposed offsets would be less than those required in an RS-3, Suburban Residence District, which is next lower tier in single family lot zoning, and the )lots WHEREAS, This would affect 28.8% of the (10 of 36 lots within the subdivision. THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego approve of the amended Overlay Planned Development. BE IT FURTHER RESOLVED, That the stated reduction in offsets constitutes a substantial change to the underlying zoning district and OPD thus requiring a Public Hearing.
