vacate the former right-of-way of Durham Road located in the NE
WHEREAS, A request has been made by Florence C. Schaefer to
1/4 of Section 24, and
WHEREAS, Durham Road was re-routed to connect to North Cape
Road in the late ~O'S, and
WHEREAS, No title information exist indicating proper road
vacation was accomplished, and
WHEREAS, The neighboring lot to the north is dependant upon
what would be the old right-of-way for access to North Cape
Road, and
effected properties and proper public notice must be given.
WHEREAS, A proper agreement must be negotiated by the two
THEREFORE BE IT RESOLVED, That the Plan Commission recommend
Durham Road onto North Cape Road be vacated subject to proper
approval to the Common Council that the former right-of-way of
access being provided to the properties effected. 0
