PCR1996185AMENDED RESOLUTION #P.C.185-96 APPROVAL OF A 20' X 30' LEAN-TO ADDITION TO A 45' X 55' ACCESSORY STRUCTURE BY SANDRA KALZYNSKI FOR THE PROPERTY LOCATED AT W184 S9405 PARKER ROAD WHEREAS, A site plan and construction information was submitted on September 6, 1996, by Sandra Kalzynski to construct a 20' X 30' Lean-to Addition to an existing 45' X 55' accessory structure at the residence located at W104 S9405 Parker Road, and WHEREAS, The location of the expanded accessory structure will meet the setback and offset requirements of the R-1/EA zoning districts and the architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The expanded accessory structure is intended to be used for horses and the Plan Commission has authority to approve the type and size of accessory structures within 1% of the total lot area, and WHEREAS, Materials submitted do not propose the use neither of this nor any other structure on the property for business related activities. the lean-to, not to exceed 600 square feet, for the Kalzynski Property. THEREFORE BE IT RESOLVED, That the Plan Commission approves of BE IT FURTHER RESOLVED, That subject accessory Structure shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building and zoning permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That prior to the issuance Of a building permit, the drainage problem between neighboring properties must be resolved.
