PCR1996163APPROVAL OF A 14' x 20' ADDITION TO A 20' X 20' RESOLUTION tP.C.163-96 ACCESSORY STRUCTURE BY JAY ERDMAN FOR THE PROPERTY LOCATED AT W175 S7121 LAKE DRIVE submitted on August 5, 1996, by Jay Erdman to construct a 14' X 20' Addition to an existing 20' X 20' accessory structure at the residence located at W175 S7121 Lake Drive, and WHEREAS, A site plan and construction information was meet the setbacks of the RS-3/0LS zoning district and the architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The location of the expanded accessory structure will used for storage of vehicle, garden equipment, and a wood working WHEREAS, The expanded accessory structure is intended to be hobby shop and the Plan Commission has authority to approve the type and size of accessory structures within 60% of the ground floor area of the residence, and WHEREAS, Materials submitted do not propose the use neither of activities, and this nor any other structure on the property for business related residence district shall be used for the carrying on of any metal WHEREAS, Section 4.05 (2) C.3 states no private garage in a working, woodworking, masonry, carpentry, contracting or repair business except as a permitted accessory use of home occupation, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of the accessory structure, not to exceed 680 square feet, for the Erdman Property. BE IT FURTHER RESOLVED, That subject accessory structure shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building and zoning permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
