PCR1996113AMENDED RESOLUTION #P.C. 113-96 APPROVAL OF THE RELOCATION OF A 31' X 30' ACCESSORY STRUCTURE FOR RUDOLPH H. HEINRICH AND PAUL GROSS AT THE PROPERTY LOCATED AT S91 W13851 BOXHORN DRIVE (TAX KEY NO. 2255.994.003) WHEREAS, Rudolph H. Heinrich and Paul Gross propose to relocate and existing 31' X 30' accessory structure off a lot line into Parcel 3 of a proposed Certified Survey Map, and was set as a condition of approval of a sketch certified survey map under Resolution #P.C. 98-96, and WHEREAS, removal or relocation of the accessory structure WHEREAS, The accessory structure will need to be reduced in size to meet the zoning district permitted accessory structure square footage, and be removed, and WHEREAS, the existing 170 square foot shed is proposed to the subject accessory structure to 27' X 30', and WHEREAS, The petitioner has proposed to reduce the size of and the Plan Commission has authority to approve the type and WHEREAS, The accessory structure use has not been stated, size of said structures, and WHEREAS, materials submitted do not propose the use neither of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the relocation of the accessory structure on to Parcel 3 of the subject survey map. BE IT FURTHER RESOLVED, That the existing 170 square foot shed be removed and that the subject accessory structure be reduced in size to 27' X 30'. shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building and zoning permit is required prior to the razing of the existing structure and prior to the construction of subject accessory structure. BE IT FURTHER RESOLVED, That subject accessory structure BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
