WERNER, 111, WHEREAS, A site plan and construction information was a 10' X 10' accessory structure with a 5' X 10' Lean-To at the residence located at S68 W19805 Black Walnut Court, and submitted on May 3, 1996, by Val G. Werner, 111, to construct calculations of the accessory structure, and WHEREAS, A lean-to is included in the overall area square foot requirement to be classified as a shed, and WHEREAS, The accessory structure and lean-to exceed the 120 WHEREAS, The location of the accessory structure will meet the setback and offset requirements of the RS-1 zoning district, which requires a 20' offset from neighboring property lines, and the storage of miscellaneous lawn equipment, and the Plan Commission has authority to approve the type and size of said structures, and WHEREAS, The accessory structure is intended to be used for neither of this nor any other structure on the property for WHEREAS, materials submitted do not propose the use business related activities, and THEREFORE BE IT RESOLVED, That the Plan Commission approve of an accessory structure, not to exceed 100 square feet with a 5' X 10' lean-to, for the Werner Property. shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building and zoning permit is required prior to the razing of the existing structure and prior to the construction of subject accessory structure. BE IT FURTHER RESOLVED, That subject accessory structure BE IT FURTHER RESOLVED, That failure to comply with the result in the issuance of fines of $100 per day per violation, terms of this resolution and the approved site plans shall the initiation of legal action, or both.
