APPROVAL OF A 16' x 22' ACCESSORY STRUCTURE
FOR KENNETH F. DOMBROWSKI
LOCATED AT W131 S6710 KIPLING DRIVE
submitted on April 1, 1996, by Kenneth F. Dombrowski to
WHEREAS, A site plan and construction information was
construct a 16' X 22' (352 square feet) accessory structure at
the residence located at W131 S6710 Kipling Drive, and
the setback and offset requirements of the RS-2, 20,000 square
WHEREAS, The location of the accessory structure will meet
foot single family Suburban Residence and the architectural
appearance would be compatible with the applicant's residence
and surrounding area, and
WHEREAS, The accessory structure is intended to be used for
the storage of miscellaneous lawn equipment, bikes, trailer
(boat), and the Plan Commission has authority to approve the
type and size of said structures, and
WHEREAS, materials submitted do not propose the use
neither of this nor any other structure on the property for
business related activities, and
WHEREAS, For properties under 120,000 square feet,
primary residential space which in this case is 1,430 square
accessory structures may equal up to 60% of the first floor
feet thus allowing a total of 858 square feet of accessory
structures, and
THEREFORE BE IT RESOLVED, That the Plan Commission approve
of an accessory structure, not to exceed 352 square feet, for
the Dombrowski Property.
BE IT FURTHER RESOLVED, That subject accessory structure
shall neither be used for the operation of a business nor the
storage of business related materials and equipment and a
building and zoning permit is required prior to construction of
subject accessory structure.
BE IT FURTHER RESOLVED, That a structure height greater
than 15 feet will require a variance from the Board of Appeals.
BE IT FURTHER RESOLVED, That failure to comply with the
terms of this resolution and the approved site plans shall
result in the issuance of fines of $100 per day per violation,
the initiation of legal action, or both.
